Terms and Conditions of Cubo’s Holiday Homes 2023 Best Photo Contest

Purpose of the competition
The aim of the competition is for guests staying in Cubo’s Holiday Homes S.L. accommodation to show how they enjoy their holiday.

About the candidates
Anyone can participate in the competition as long as it takes place during the stay and in the accommodation provided by Cubo’s Holiday Homes S.L.
Members of staff of Cubo’s Holiday Homes S.L. or Cubo’s Holiday Homes’ partner companies (whether permanent or temporary, current or ex-employees), or an immediate family member of any such person, are eligible to enter, but are not eligible to win.

Technical specifications of the submitted photo(s)
Photo(s) must be submitted in high resolution JPEG/PNG format (as high as your camera will allow). If you do not have a high quality camera, please send your photos, but please note that they cannot appear in the printed Report. However, you can still enter and win the competition and its prizes. The photo must not contain violence, profanity, sex or direct attacks on individuals or organisations. Any photo that is deemed offensive or does not serve the purpose of the competition will be immediately disqualified or deleted.

The photo must be an original creation – copyrighted images may not be used.
The entrant must certify and guarantee that the photo(s) submitted do not violate the rights of a third party or any copyright. Cubo’s holiday homes S.L., is not responsible for any intellectual property violations that may result from the submission of photographs.

Selection and notification of the selected photographers
Once the competition closes at 11.59 p.m. on 31 December 2023 (Spanish time), the winning photo will be the one with the highest number of points for all its ratings. In the event of a tie, it will be decided according to the order in which the photos have been published in the system.
The decision of the winning photo will be final.
Any attempt by an entrant to influence the outcome or subvert the photo competition will result in immediate disqualification.
The winning photograph will be selected on the first Monday in 2024, and the photographer will be notified by email.
If an entrant cannot be contacted after reasonable attempts to contact him or her, the Cube’s Holiday Homes S.L., reserves the right to offer the prize to the next best photo.

If it is proven, or discovered, at any time, any deception regarding the winning photo of the competition, in terms of authorship, place, date, etc., the prize may be revoked and the winner will lose all rights to enjoy the prize.

Price

The prize will consist of a week’s holiday (7 nights) at Cubo’s Villa Llanos de la Plata property (link), for up to 10 people, at the traveller’s choice, on the dates available for booking between 1 January 2024 and 31 December 2024, at the time of the winning participant’s choice of dates, and in no case will this prize be exchangeable for any financial amount.

The maximum period for choosing the week’s holiday at the property is 30 calendar days from the time the winner claims the price.

Rights and ownership
By submitting their photos to the Cubo’s Holiday Homes S.L., entrants agree to grant free of charge to the Cubo’s Holiday Homes S.L. the right to use the photo in any way and in any medium, including, without limitation, the right to publish, adapt, distribute, copy, display or translate in print or electronic media the photo, even if they are not the winning photos.

The photographs entered in the competition will become the property of Cubo’s Holiday Homes S.L. and may be used by the company for any direct or indirect advertising campaign carried out by Cubo’s Holiday Homes S.L..

Cubo’s Holiday Homes S.L., is not responsible for the use of copyrighted photographs, being the entrant responsible for any claim that a third party may make on the rights of such photographs.

General
The Cube’s Holiday Homes S.L. reserves the right to modify or cancel the contest or any of the arrangements, schedules, plans or other elements directly or indirectly related to the contest, at any time and for any reason if deemed necessary.
Personal information provided to Cubo’s Holiday Homes S.L. by entrants will only be used for the purposes of this competition. All participants have the right to access, cancel, oppose and rectify the personal data (email) on file by sending their request by email to info@cubosmybestholiday.com.
Participation in the competition, including the selection of the photograph, does not in any way constitute an endorsement or support by Cube’s Holiday Homes S.L. of the candidates’ opinions or objectives or of any product or service. Candidates may not advertise or otherwise claim to have obtained such endorsement or support. The Cubo’s Holiday Homes S.L. name and logo are the property of Cubo’s Holiday Homes S.L. and must not be used in any way without the prior consent of Cubo’s Holiday Homes. 
Cubo’s Holiday Homes S.L. must approve in writing any statement, advertisement, press release or similar communication in any media, when it relates to the candidates’ participation in the competition.

De conformidad con lo establecido en la normativa aplicable en materia de protección de datos, y concretamente en el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos, cada participante, con la aceptación de estas Bases Legales consiente que los datos personales facilitados para la participación en este concurso sean incorporados a un fichero titularidad de Cubos Holiday Homes S.L para tramitar la participación en el concurso y para comunicarle el premio en caso de que resultase ganador.

Los participantes garantizan que los datos personales facilitados son veraces y se hacen responsables de comunicar a Cubos Holiday Homes S.L  cualquier modificación de los mismos. Cubos Holiday Homes S.L se reserva el derecho a excluir de la presente promoción a todo Participante que haya facilitado datos falsos. 

Los Participantes tienen derecho a (i) acceder a sus datos personales, así como a (ii) solicitar la rectificación de los datos inexactos o, en su caso, solicitar su supresión, (iii) solicitar la limitación del tratamiento de sus datos, (iv) oponerse al tratamiento de sus datos y (v) solicitar su portabilidad.
